If a Muslim man, in a moment of anger, said to his wife, ‘I give you divorce’ three times. Can you or any Muslim scholar please guide me on whether they are considered divorced according to Islamic law? I would appreciate some guidance.
If a man divorces his wife in anger but he is still mentally aware (not insane or out of control), then the divorce is valid. In that case, it counts as one revocable divorce, and he can take her back during the ‘iddah, with two divorces still remaining.
However, if the anger reaches the level where he becomes mentally unstable or unaware of what he is saying, then the divorce is not valid, because intention and awareness are required.
The Prophet Muhammad strongly disliked misuse of divorce. When he was informed about a man who gave three divorces at once, he became angry and said:
“Are you playing with the Book of Allah while I am still among you?”
(Sunan an-Nasa’i)
This shows that giving divorce in a careless or extreme manner is against the proper Islamic method.
Later, Umar ibn al-Khattab saw people repeatedly misusing this, so he enforced the ruling that three divorces at once would count as final, to discipline people and stop them from playing with the law.
