Introduction 

Marrying a man with a pre-planned intention of divorce in order to make a woman lawful again for her first husband—after he has issued three divorces—is ḥarām, deceptive, and an invented practice outside the Sharīʿah of the Final Prophet of Allah 

Allah says:

“If he divorces her (for the third time), she is not lawful for him afterward until she marries another husband.”(Surah al-Baqarah 2:230)

This verse refers to a real and lawful marriage, not a temporary arrangement designed to bypass Allah’s limits.

The Role of Mahr and Responsibility

In Islam, mahr is not a fee or a tool for manipulation, but a mandatory obligation given by the husband with sincere intention of a lawful and lasting marriage. It symbolizes honor, responsibility, and commitment.

Allah ﷻ says:

“And give the women their mahr graciously.”(Surah al-Nisāʾ 4:4)

Allah has made men guardians and maintainers (qawwāmūn) over women due to the responsibilities He placed upon them, including financial support, protection, and sincere marital commitment:

“Men are caretakers of women because Allah has given some more strength than others and because they spend from their wealth.”(Surah al-Nisāʾ 4:34)

Using mahr as a payment for a temporary or pre-planned divorce marriage violates its purpose and corrupts the institution of nikāḥ.
